Welcome to any.market! These Terms of Service ("Terms") govern your access to and use of any.market website, platform, and related services (collectively, the "Services"). Our platform offers three ways to create your online store: AI-powered creation from an existing Google Business Profile, manual creation with full control over your content, or our paid Done-For-You Profile Creation service for businesses not yet on Google. Please read these Terms carefully.

1. Acceptance of Terms

By accessing or using any.market, you agree to be bound by these Terms and our Privacy Policy. If you don't agree to these Terms, you may not access or use our Services.

Important: These Terms constitute a legally binding agreement between you and any.market, Corp. Please ensure you have the authority to enter into this agreement.

2. Eligibility

You must meet the following requirements to use our Services:

  • Be at least 18 years old
  • Have the legal capacity to enter into a binding contract
  • Not be prohibited from using our Services under applicable laws
  • A Google account is required for AI-powered store creation and for Done-For-You Profile Creation. An existing Google Business Profile is required only when using AI-powered creation from an existing profile.
  • Done-For-You Profile Creation is available only for businesses eligible for a Google Business Profile under Google's guidelines (e.g., a real street address or service area; PO boxes, virtual offices, and online-only businesses are not eligible). We check eligibility before charging; if your business is not eligible, we will not charge you.
  • Provide accurate and complete registration information

3. Account Registration and Data Collection

Vendor Account Creation (Store Owners)

To create and manage your store, you must provide:

  • Email address
  • Name
  • Phone number
  • Password (stored as secure hash)
  • Optionally: Connect your Google Business Profile for AI-powered store creation

End Customer Accounts (Store Shoppers)

Customers shopping on stores hosted by any.market may create accounts. We collect:

  • Email address
  • Phone number
  • Password (stored as secure hash)
  • Shopping cart and order information

✓ Data Controller

any.market acts as the data controller for both vendor accounts and end customer data. We are responsible for protecting this information in accordance with applicable privacy laws.

Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Using strong passwords and enabling security features

Security Notice: We will never ask for your password via email or phone. Do not share your credentials with anyone. Passwords are stored as secure hashes and never in plain text.

4. Services Description

any.market provides the following services:

Three Store Creation Methods:

AI-Powered Creation: Transform your Google Business Profile into a professional online store automatically using AI

Manual Creation: Build your store manually from scratch with full control over all content and design

Done-For-You Profile Creation (paid): for businesses not yet on Google, we create a new Google Business Profile under yourGoogle account using the business information you provide, build your storefront page, place the storefront URL in the profile's website field, and submit the profile to Google for verification. You own the profile and everything in it.

  • Store Hosting: Secure hosting for your online store
  • Content Management: Tools to customize and manage your store content
  • Analytics: Track visitor behavior and store performance
  • Technical Support: Customer support for platform-related issues

Storefront Pages from Public Sources

any.market may generate storefront pages for local businesses using publicly available business information (such as data available through the Google Places API). These pages exist to make local businesses discoverable and can be claimed by their owners at any time. If you represent a business shown on any.market, you may: (a) claim the page and correct or manage its content, or (b) request its permanent removal at privacy@any.market or via the link on the page. Removal requests are honored promptly: we remove the page, request de-indexing from search engines, and add the business to a suppression list so the page is not automatically re-created from public data.

5. Subscription and Payment Terms

Subscription Plans

We offer various subscription tiers with different features and pricing. Current plans and pricing are available on our website.

✓ Payment Processing

We do NOT store payment information. All payment processing is handled by third-party payment processors for:

  • Your subscription fees and one-time setup purchases (vendor account)
  • Customer transactions on your store

We never have access to full payment card details or financial information.

Payment

  • Subscriptions are billed on a recurring basis (monthly or annually)
  • You authorize third-party payment processors to charge your payment method for subscription fees
  • Subscription fees are non-refundable unless required by law
  • We reserve the right to change pricing with 30 days notice

One-Time Setup Services ($97 Done-For-You Setup)

In addition to subscriptions, we offer a one-time paid setup service. For this service:

  • The fee is charged once. It is not a subscription and does not renew.
  • Money-back guarantee: if we fail to build and submit your Google Business Profile, or your storefront page is not made live, you are entitled to a full refund. Additionally, if Google determines your business is not eligible to undergo verification, you are entitled to a full refund.
  • What the guarantee does not cover:verification approval, verification method, and verification timing are determined solely by Google. We prepare your profile to Google's guidelines and guide you through whichever verification method Google assigns, at no extra charge, but we cannot and do not guarantee that Google approves a listing or how long approval takes.
  • Refund requests: support@any.market. Refunds are issued to the original payment method.

Customer Transactions

Your store includes shopping cart functionality with integration to third-party payment processors. We provide the platform and integration, but we do NOT process financial transactions directly. All payment processing is handled by third-party services.

Cancellation

You may cancel your subscription at any time. Upon cancellation:

  • You retain access until the end of your billing period
  • No refunds are provided for partial billing periods
  • Your store data will be retained per our data retention policy

6. User Conduct and Prohibited Uses

You agree NOT to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems
  • Use our Services for illegal activities or fraud
  • Harass, abuse, or harm other users
  • Scrape or harvest data from our platform without permission
  • Create stores selling prohibited items (weapons, drugs, counterfeit goods)
  • Impersonate others or provide false information
  • Interfere with the proper functioning of our Services

Enforcement: Violation of these terms may result in immediate account suspension or termination without refund.

7. Google Business Profile Data (AI-Powered Creation & Done-For-You Setup)

✓ Separate Feature

If you don't have a Google Business Profile, you can create your store manually without any Google data, or use our paid Done-For-You Profile Creation service (described below) to have a new profile created for you. The preview and claim steps described immediately below apply only if you have a GBP and choose to use AI-powered store creation.

✓ Two-Step Process

Step 1 - Preview (No OAuth): Enter your business name at gbp.any.market. We show you a store preview using publicly available data from Google Places API. No authentication needed.

Step 2 - Claim Business (OAuth Required): If you choose to claim your business, we request OAuth access to access menu data and write your store URL to your GBP profile.

Done-For-You Profile Creation (OAuth Required — paid service)

When you purchase Done-For-You setup, after payment you sign in with your Google account and authorize us to create and populate a new Business Profile under your account. We write the information you provided in the order form (business name, address, category, phone, hours, description, photos) and place your storefront URL in the profile's website field. The profile belongs to you from the moment of creation; we do not retain ownership or ongoing management access beyond what is needed to complete setup. Verification is completed by you with Google; we provide guidance until it is resolved.

✓ Data Handling Commitment

We do not store raw Google Business Profile API data. Menu data is accessed on-the-fly, transformed immediately by AI, and never retained. We perform a single one-time write to your website field. No ongoing access. If your profile's website field already contains a URL, we will not overwrite it without your explicit confirmation during setup. You may change or remove the storefront URL from your profile at any time; the storefront itself remains yours and can be edited or deleted from your dashboard.

Public Data Access (Google Places API - No Authentication)

For store preview, we access publicly available data:

  • Business name, address, phone, publicly listed website
  • Business hours and operational details
  • Customer reviews and ratings (public API only)
  • Photos and media content (publicly available)

Authenticated Data Access (OAuth - When You Claim Your Business)

When you claim your business via OAuth (business.manage scope), we access:

  • READ: Menu data unavailable via public API (transformed on-the-fly, NOT STORED)
  • WRITE: Your store URL to GBP website field (one-time update at creation)

Scope Justification: We require business.manage for:

  • READ menu data (unavailable via public API)
  • WRITE store URL to website field (one-time)
  • CREATE and populate a new Business Profile at your direction (Done-For-You setup only)

WHY NARROWER SCOPES INSUFFICIENT: business.manage is the ONLY scope with both menu read AND website write access.

We do NOT access customer data, transaction history, or any private information beyond menu items and the website field.

How We Use This Data

  • Public API Data: Generate store preview with AI transformation
  • Menu Data (OAuth): Read menu items, transform on-the-fly with AI, generate product pages (NOT STORED)
  • Website Write (OAuth): Add your store URL to your GBP website field (one-time only)
  • Content Display: Show transformed content and public reviews on your store

Your Rights

  • Preview your store using public data before any OAuth connection
  • Choose whether to claim your business (OAuth is optional)
  • Disconnect your Google Business Profile at any time after store creation
  • Control what information is displayed on your store
  • Request deletion of your transformed store data
  • Revoke access permissions through your Google account

Google API Services User Data Policy Compliance: We comply with Google API Services User Data Policy, including Limited Use requirements. We never sell your data or use it for advertising purposes.

8. Intellectual Property Rights

Your Content

You retain all ownership rights to the content you provide and the AI-generated store content. By using our Services, you grant us a limited license to host, display, and process your content as necessary to provide our Services.

Our Platform

The any.market platform, including its design, functionality, code, and branding, is owned by any.market, Corp. and protected by intellectual property laws. You may not:

  • Copy, modify, or reverse engineer our platform
  • Remove or alter any proprietary notices
  • Use our trademarks without written permission
  • Create derivative works based on our platform

9. Service Availability and Modifications

We strive to provide reliable Services, but we reserve the right to:

  • Modify, suspend, or discontinue any aspect of our Services
  • Perform scheduled or emergency maintenance
  • Update features and functionality
  • Change pricing and subscription plans with notice

We will provide reasonable notice for significant changes that materially affect your use of the Services.

10. Termination

Termination by You

You may terminate your account at any time by following the account closure process in your settings.

Termination by Us

We may suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent or illegal activities
  • Your payment method fails repeatedly
  • Your account has been inactive for an extended period
  • Required by law or regulatory authorities

Effects of Termination

Upon termination:

  • Your access to the Services will cease immediately
  • Your store will be taken offline
  • Your data will be handled according to our Privacy Policy
  • No refunds will be provided for prepaid subscription periods

11. Disclaimers and Warranties

AS-IS BASIS: Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied.

We disclaim all warranties, including but not limited to:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties that the Services will be uninterrupted or error-free
  • Warranties regarding the accuracy or reliability of AI-generated content
  • Warranties that the Services will meet your specific requirements

You are solely responsible for reviewing and verifying all AI-generated content before using it in your store.

12. Limitation of Liability

IMPORTANT LIMITATION: To the maximum extent permitted by law, any.market shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

Our total liability to you for any claims arising from or related to the Services is limited to:

  • The amount you paid us in the 12 months preceding the claim, or
  • $100 USD, whichever is greater

Some jurisdictions do not allow the limitation of certain damages, so these limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless any.market, Corp., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you upload or display on your store
  • Your business activities and transactions

14. Dispute Resolution and Arbitration

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Arbitration Agreement

Any dispute arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except for:

  • Intellectual property disputes
  • Small claims court matters (under jurisdictional limits)

Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions, class arbitrations, or representative actions.

15. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and any.market regarding the Services.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.

16. Changes to These Terms

We may update these Terms from time to time. When we make changes:

  • We will update the "Last Updated" date
  • For material changes, we will notify you via email or platform notification
  • Continued use after changes constitutes acceptance of the new Terms
  • If you don't agree to the new Terms, you must stop using the Services

18. Acknowledgment

By using any.market, you acknowledge that:

  • You have read and understood these Terms of Service
  • You have read and understood our Privacy Policy
  • You agree to be bound by these Terms and our Privacy Policy
  • You have the authority to enter into this agreement
  • You understand that AI-generated content (if using AI-powered creation) requires your review and verification
  • You can choose between AI-powered, manual, and Done-For-You store creation methods
